TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the services provided by Press Monkey Media LLC ("Press Monkey", "we", "us", or "our"), including the website at pressmonkey.co and any related software, tools, or services (collectively, the "Service"). By using the Service, you agree to these Terms.

1. The Service

Press Monkey is an AI-powered PR automation tool that helps you draft press pitches, find journalists, run outreach campaigns, and book podcast appearances. It assists your decision-making. It does not guarantee coverage or journalist replies.

2. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement and that you have the authority to agree to these Terms on behalf of any organization you represent.

3. Account registration

You're responsible for keeping your account credentials private and for everything that happens under your account. If someone gets in without your permission, tell us right away via the contact form.

4. Acceptable use

You can't use the Service to:

• Send unsolicited bulk email that violates applicable law (CAN-SPAM, CASL, GDPR)
• Pitch content that is false, misleading, or defamatory
• Impersonate any person, organization, or entity
• Export journalist contact data for use outside the Service
• Interfere with or disable any security features of the Service
• Do anything that violates applicable law or regulation

5. Subscriptions and billing

Paid features are billed in advance, monthly or annually, in US dollars. Fees are non-refundable except where these Terms say otherwise or law requires it. Annual subscriptions can be cancelled at any time but are not eligible for pro-rata refunds. Monthly subscriptions cancel at the end of the current billing period.

6. Free trial

We offer a 7-day trial on the Launch plan. When it ends, your account won't convert to a paid plan unless you add a payment method. We can change or end trial offers at any time.

7. Intellectual property

Press Monkey owns the Service, including all software, design, and technology. You own all content you submit (press release drafts, company info, campaign briefs). You give Press Monkey a limited license to use that content only to run and improve the Service.

8. Journalist data

The journalist database and pitch lists are proprietary to Press Monkey. You can't export, copy, or distribute this data outside the Service, and you can't use it after your subscription ends.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PRESS MONKEY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULTS WILL BE ACHIEVED, INCLUDING MEDIA COVERAGE, JOURNALIST RESPONSES, OR PODCAST BOOKINGS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRESS MONKEY IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WON'T EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM.

11. Termination

We can suspend or terminate your access if you violate these Terms or if your use poses a risk to the Service or other users. You can terminate at any time by cancelling through the dashboard or by contacting us.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States. Any disputes will be resolved in the courts of Philadelphia County, Pennsylvania.

13. Changes to these Terms

We update these Terms when needed. For material changes, we'll notify you by email or through a notice in the Service. Continued use after the effective date means you accept the changes.
